ViralBurst — End User License Agreement (EULA)

This End User License Agreement ("Agreement") is a legal agreement between

you ("User") and ViralBurst ("Licensor") for the software

product ViralBurst, including associated files, installers, and

documentation (the "Software").

By installing, copying, or using the Software, you agree to be bound by

the terms of this Agreement. If you do not agree, do not install or use

the Software.

1. License Grant

Subject to your compliance with this Agreement, Licensor grants you a

non-exclusive, non-transferable license to install and use the Software

on devices you own or control, for personal and/or commercial purposes.

Each license key may be activated up to three (3) times total. This

covers normal reinstallation (for example, after a system reset or a

new computer) as well as installing on more than one device. Once a

license key has reached its activation limit, a new license must be

purchased to continue installing or reinstalling the Software.

Licensor may, at its discretion, reset a license's activation count for

legitimate reinstallation needs — contact viralburstai@gmail.com if

you believe this applies to you.

2. Ownership

The Software is licensed, not sold. Licensor retains all right, title, and

interest in and to the Software, including all intellectual property

rights, except for the third-party components listed in

THIRD_PARTY_NOTICES.md, which remain the property of their respective

owners under their own licenses.

3. Restrictions

You may not:

standalone product;

extent applicable law expressly permits despite this restriction;

4. Your Content and Responsibility

The Software processes video files and URLs that you provide. You are

solely responsible for:

process any video or audio content you supply to the Software,

including content downloaded via URL;

YouTube) from which you supply a URL for download;

regarding any content you process, edit, or distribute using the

Software's output.

Licensor does not review, monitor, or control the content you process and

is not responsible for how you use the Software's output.

5. Third-Party Components

The Software includes or automatically installs certain third-party

software components (ffmpeg, NVIDIA CUDA libraries, and various

Python packages), each under its own license terms. See

THIRD_PARTY_NOTICES.md for details. Your use of those components is

also subject to their respective license terms, including, where

applicable, the GNU General Public License (ffmpeg) and NVIDIA's End

User License Agreement (CUDA libraries).

6. No Warranty

THE SOFTWARE IS PROVIDED "AS IS," WITHOUT WARRANTY OF ANY KIND, EXPRESS OR

IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY,

FITNESS FOR A PARTICULAR PURPOSE, AND NONINFRINGEMENT. LICENSOR DOES NOT

WARRANT THAT THE SOFTWARE WILL BE ERROR-FREE OR UNINTERRUPTED.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL

LICENSOR BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL,

OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR DATA, ARISING OUT OF OR

RELATED TO YOUR USE OF THE SOFTWARE, EVEN IF ADVISED OF THE POSSIBILITY

OF SUCH DAMAGES. LICENSOR'S TOTAL LIABILITY UNDER THIS AGREEMENT SHALL

NOT EXCEED THE AMOUNT YOU PAID FOR THE SOFTWARE, IF ANY.

8. Termination

This Agreement is effective until terminated. Your rights under this

Agreement will terminate automatically without notice if you fail to

comply with any of its terms. Upon termination, you must cease all use

of the Software and destroy all copies.

9. Governing Law

This Agreement shall be governed by the laws of The State of Maryland,

United States of America, without regard to its conflict of laws

principles.

10. Entire Agreement

This Agreement constitutes the entire agreement between you and Licensor

regarding the Software and supersedes all prior agreements, whether

written or oral.
